Welcome to OmniPay.cc ("OmniPay," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website and services, including cryptocurrency purchase functionality powered by Stripe's Crypto Onramp (collectively, the "Services").

By using OmniPay.cc, you agree to these Terms and our Privacy Policy. If you do not agree, please discontinue use of our Services.

1. Eligibility

You must:

  • Be at least 18 years old (or the age of legal majority in your jurisdiction).
  • Be a resident of one of our supported regions: United States; European Union, United Kingdom, Norway, or Switzerland; or Australia, Singapore, or New Zealand.
  • Not be located in or a resident of any prohibited jurisdiction, including Cuba, Iran, North Korea, Syria, or the Crimea, Donetsk, and Luhansk regions of Ukraine.
  • Use our Services for lawful purposes only.

You are responsible for ensuring that your use of cryptocurrency and related financial tools complies with all applicable laws and regulations in your jurisdiction.

2. Relationship With Stripe

OmniPay.cc uses Stripe's Crypto Onramp to process cryptocurrency purchases. When you complete a transaction, you are also entering into an agreement directly with Stripe, Inc. and subject to its Terms of Service and Crypto Onramp Terms.

Stripe handles all payment processing, verification, and compliance requirements (including Know Your Customer "KYC" and Anti-Money Laundering "AML" checks). OmniPay.cc does not store, process, or control your payment credentials or personal verification data.

Compliance with Stripe's Crypto Onramp Terms

OmniPay.cc uses Stripe's regulated Crypto Onramp to process payments. By purchasing cryptocurrency through OmniPay.cc, you also agree to comply with the Stripe Crypto Onramp Merchant Terms of Service and Stripe Restricted Businesses Policy.

OmniPay.cc does not permit use of its services in or by individuals or entities located in any jurisdiction prohibited by Stripe or applicable U.S. law, including Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine.

3. Nature of the Service

OmniPay.cc provides access to a user-friendly platform for purchasing cryptocurrency via Stripe's Crypto Onramp. We do not:

  • Operate as a bank, exchange, broker-dealer, money transmitter, or custodian.
  • Hold or store your cryptocurrency or fiat funds.
  • Provide financial, investment, or tax advice.

You are solely responsible for understanding the risks associated with cryptocurrency transactions and should consult a qualified professional before making any financial decisions.

4. Account and Identity Verification

To comply with regulatory requirements, you may be asked to provide identification or verification information before completing a transaction. All verification is handled directly by Stripe. OmniPay.cc does not receive or retain your identity documents or payment account information.

5. Fees and Pricing

Transaction fees are determined and displayed by Stripe during checkout. OmniPay.cc may receive a commission or service fee from Stripe for facilitating purchases. Prices and fees are subject to change without notice.

6. Refunds and Chargebacks

Cryptocurrency transactions are final and irreversible once completed on the blockchain. By using OmniPay.cc, you acknowledge and agree that:

  • You cannot reverse, refund, or cancel completed transactions.
  • Stripe's standard refund or chargeback protections for card payments do not apply once cryptocurrency is delivered.
  • OmniPay.cc has no ability to recover funds once transmitted on-chain.

7. Risks and Disclaimers

By using OmniPay.cc, you understand and accept the following:

  • Volatility: Cryptocurrency prices can fluctuate dramatically, and you may lose value.
  • Regulatory Risk: Crypto laws may change and impact your rights or access.
  • Security Risk: Blockchain transactions are irreversible; if your wallet or private keys are compromised, funds may be permanently lost.
  • No Guarantees: OmniPay.cc makes no representations or warranties about future value, performance, or suitability of any cryptocurrency.

You agree to use OmniPay.cc at your own risk.

8. Prohibited Activities

You agree not to use OmniPay.cc to:

  • Engage in or facilitate illegal activity (including money laundering or terrorist financing).
  • Misrepresent your identity or source of funds.
  • Violate any applicable laws, sanctions, or regulations.
  • Attempt to bypass KYC/AML requirements.
  • Interfere with or disrupt our website or systems.
  • Access the service from prohibited jurisdictions.
  • Conduct transactions on behalf of sanctioned individuals or entities.

We reserve the right to suspend or terminate your access for any violation of these Terms or Stripe's policies.

9. Limitation of Liability

To the maximum extent permitted by law:

  • OmniPay.cc and its affiliates, officers, employees, and partners shall not be liable for any direct, indirect, incidental, consequential, or special damages, including but not limited to loss of funds, profits, or data, arising from your use of the Service.
  • Our total liability to you for any claim shall not exceed the total fees (if any) paid by you to OmniPay.cc in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless OmniPay.cc, its affiliates, and its service providers (including Stripe) from any claims, damages, losses, or expenses arising from:

  • Your use or misuse of the Services.
  • Your violation of these Terms or any applicable laws.
  • Your negligence or misconduct.

11. Modifications to the Service

We may modify, suspend, or discontinue any part of our Services at any time without notice. We may also update these Terms periodically. Continued use after updates constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes shall be resolved in accordance with the dispute resolution procedures applicable in your jurisdiction.
